By accessing our platforms or using our services, you agree to comply with these Terms. This document is designed to promote transparency, protect user rights, and ensure responsible use of our offerings.

 

  1. Introduction

Capimore Ltd (“Capimore”, “we”, “us” or “our”) is a financial services provider licensed to offer microloans—including SME- and salary-based loan products—in Nigeria. These Terms govern your access to and interaction with our website, digital tools, customer service touchpoints, and all financial services rendered.

 

  1. Acceptance of Terms

By accessing our platform or applying for a loan through Capimore, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please refrain from using our services. Continued use signifies ongoing acceptance.

 

  1. Eligibility & Age Restriction

You must be at least 18 years of age to access or use Capimore’s services. By using our platform, you confirm you meet this requirement and have the legal capacity to enter into a binding contract. Capimore is not liable for any misrepresentation of age or identity.

 

  1. Privacy & Data Protection

We are committed to protecting your personal information. Your data is collected, processed, and stored in line with relevant data protection laws. By using our platform, you agree to our Privacy Policy regarding data handling—including loan applications, communication, and uploaded documents.

 

  1. Creating an Account

To access Capimore’s services, you may need to create an account and provide personal information. You agree to submit accurate, complete, and current data. You are responsible for all activities under your account and for safeguarding your login credentials.

 

  1. Use of the Platform

Our digital platforms are intended for personal, non-commercial use. You agree to use the platform lawfully and for its intended purposes. Unauthorized actions such as scraping, duplicating content, or disrupting system operations are strictly prohibited.

 

  1. Transacting on the Platform

All transactions—including applications, agreements, disbursements, and repayments—must be conducted in good faith. Capimore may verify submitted data and reserves the right to decline or revoke access in cases of fraud, suspicious activity, or inaccuracies.

 

  1. Communication & Electronic Records

By using our services, you consent to receive communications electronically (email, SMS, WhatsApp, or in-app messages). These communications meet legal requirements for written records. Digital copies of applications and agreements may be issued and stored electronically.

 

  1. Customer Obligations

You agree to:

  • Provide accurate and complete information
  • Repay loans as agreed
  • Respond promptly to Capimore and its agents
  • Avoid impersonation or identity misrepresentation
  • Refrain from using another person’s documents or card details

 

  1. Loan Agreement

Accepting a loan offer from Capimore constitutes a binding agreement. This outlines the loan amount, interest rate, repayment plan, and all applicable terms. You must comply with all loan terms, including timely repayment.

 

  1. Loan Disbursement

Loans are disbursed subject to compliance with requirements including KYC checks, document verification, and guarantor validation. Capimore may delay or deny disbursement if fraud or incomplete data is suspected.

 

  1. Repayment Obligations

Repayments must be made fully and on time. Accepted methods include direct debit, salary deductions, bank transfers, or POS payments. Early repayment is penalty-free. Borrowers who repay 70–80% of their loan may qualify for a top-up.

 

  1. Default & Late Payment

Failure to repay on time is a default. Capimore may:

  • Charge 2% weekly late fees on overdue balances
  • Report defaulters to credit bureaus (e.g., CRC, FirstCentral)
  • Engage third-party recovery agents
  • Enforce collateral or guarantees

Defaulting may affect future loan eligibility.

 

  1. Liability & Indemnity

Capimore is not liable for losses due to user error, misinformation, or contract breaches. You agree to indemnify and hold Capimore and its affiliates harmless from any claims or damages resulting from your actions or legal violations.

 

  1. Data Privacy

We handle personal data in line with applicable laws. By using our platform, you consent to data processing for identity verification, credit checks, and loan servicing. You may withdraw consent at any time; however, this does not affect past lawful processing.

 

  1. User Data Security

We employ technical and administrative measures to safeguard your data. However, we do not guarantee absolute protection against cyberattacks or system failures. Users must protect their account credentials and notify us immediately of unauthorized access.

 

  1. Card and Payment Details

Bank and card details may be required for disbursement or repayment. These are securely stored and used only for authorized purposes. By submitting your details, you authorize Capimore to initiate transactions per the loan agreement.

 

  1. Intellectual Property

All platform content—logos, designs, text, software—is the intellectual property of Capimore Ltd. Unauthorized use, reproduction, or distribution without permission is prohibited and may lead to legal consequences.

 

  1. Authorized Use

Users must use our services lawfully. Fraudulent activity, unauthorized access, or attempts to disrupt the platform are breaches of these Terms and may result in account termination and legal action.

 

  1. Disclaimer of Warranties

Our services are provided “as is” and “as available” with no express or implied warranties. We do not guarantee uninterrupted service. All warranties, including merchantability and fitness for a particular purpose, are disclaimed to the extent permitted by law.

 

  1. Limitation of Liability

Capimore is not liable for indirect or consequential damages. Total liability is limited to the amount of service fees (if any) paid in the 6 months prior to a claim.

 

  1. Indemnity

You agree to indemnify Capimore, its officers, employees, and affiliates from claims or losses arising from your breach of these Terms or misuse of the platform.

 

  1. Termination & Suspension

We may suspend or terminate your access without notice if you breach these Terms or harm our operations, users, or reputation. This does not affect prior rights or obligations. You may also request account closure at any time.

 

  1. Dispute Resolution

In case of a dispute, both parties shall attempt amicable resolution first. If unresolved, matters will be referred to mediation or arbitration under the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria, 2004.
All disputes are governed by the laws of the Federal Republic of Nigeria.
